Abstract

This article deals with social and political conditions, as well as peculiarities of development and enactment of the Basic Law (Constitution) for the Federal Republic of Germany in 1949. On the basis of analysis of the contents of its articles the author explores the role of various political forces in the process of formation of social constitutional state (Rechtsstaat) in the Federal Republic of Germany. It is emphasized that the Basic Law is inextricably linked the concept of the rule of law with the notion of the welfare state, designed to interact with and complement each other. The study suggests consensual character as public and political and social and legal frameworks of new German state, that were formed under the strict control of three Western occupying powers victorious substantially approving them.
