Abstract

In the article it is said about entry into force of the Federal Law № 23-FZ from 04.03.2013 that created need for the clarification of the existing concept of «non-procedural knowledge». Actions of the legislator, that don’t take into account the historical experience of the existing domestic criminal procedural regulation, add character of procedural knowledge to actions carried out at the stage of initiation of criminal proceedings (Art. 144) than break the accepted rules of admissibility of evidence and stages of construction of the criminal proceedings.
