The author conducts a comparative analysis of the legal acts of Germany, France and England, which provides a justification for why the German model could be considered the most progressive at that time. It also highlights the features of countries that may have influenced the direction of legislation development. The comparison is based on such important aspects as the list of persons entitled to initiate an insolvency case, the list of entities entitled to insolvency, the public's attitude to bankrupts, methods of resolving insolvency cases, bodies of bankruptcy proceedings, personal consequences for the insolvent debtor, and state participation in the process.</p>институт несостоятельностизаконодательство о банкротствеевропейское правоистория праваinstitution of insolvencybankruptcy legislationeuropean lawhistory of law
