The author draws attention to the ambiguous judicial practice on the issue. Overall it is concluded that the provisions of the labour legislation in the part of the unmotivated dismissal of the head meets the criteria for the admissibility of limitations of the principle of freedom of labour provided for in part 3 of article 55 of the Constitution, as introduced with the aim of protecting the rights and lawful interests of other persons - employer or founder. The introduction of an appropriate basis for dismissal of the head of the organization «balances» the broad powers granted to the Director and the payment of appropriate compensation to him.
